OPERA UNDER THE STARS®   
Terms and Conditions including COVID-19 Policy (3 May 2022) – Please read carefully


1. Please read these Terms and Conditions and COVID-19 Policy (Point 24 below), carefully prior to purchasing a ticket to OPERA UNDER THE STARS®. By making a purchase you are agreeing to these Terms and Conditions including COVID-19 Policy.

2. Should OPERA UNDER THE STARS® or its host venue, Mangrove Hotel, become impacted by any government mandated requirements e.g. in relation to COVID-19, it is a condition of entry that you will need to comply with those requirements or present evidence of a sufficient medical exemption if applicable. Anyone who is required to comply with a government order and does not have a valid exemption will be denied entry and no ticket refund will apply. By purchasing a ticket you are agreeing to keep up to date with any government mandated requirements e.g. in relation to COVID-19. Current information regarding COVID-19 management requirements in Western Australia can be accessed via the OPERA UNDER THE STARS® website at the bottom of the Home Page at www.operaunderthestars.com.au 

3. If a future change to government mandated requirements produces a change/restriction to venue capacity OPERA UNDER THE STARS® may need to cancel and refund a portion of purchased tickets. Should such a venue capacity change be required, the most recently purchased tickets will be cancelled first. That is, tickets purchased early will take priority. Therefore, we advise patrons to book as early as possible to avoid disappointment. Please refer to Point 10 below.

4. Masks are currently not mandatory to be worn at events in Western Australia, however, all patrons are requested to bring a mask with you in case government requirements in relation to COVID-19 and the wearing of masks change between the time of ticket purchase and the event. Please refer to Point 2 above.

5. If you are purchasing tickets on behalf of someone else, it is your responsibility to inform them of these Terms and Conditions including COVID-19 Policy (Point 24 below) and any other terms and conditions notified at the time of sale.

6. Tickets purchased are subject to the conditions applicable to the venue where OPERA UNDER THE STARS® is presented and all liquor licensing laws and government requirements regarding COVID-19 apply.

7. Bar Service is available before the start of the performance and during Interval.

8. Tickets are sold subject to the Terms and Conditions including COVID-19 Policy displayed at the point of sale and/or at the event. Tickets are only valid when purchased through an authorised agent. It is a condition of sale that tickets may not be offered for unauthorised resale on third party websites e.g. Ebay. Tickets may not be resold or offered for resale at a premium or used for advertising, promotional or other commercial purposes. The validity of any ticket offered for resale on third party websites cannot be guaranteed. If a ticket is used in breach of these Terms and Conditions including COVID-19 Policy it may be cancelled without refund and the ticket bearer may be refused admission.

9. Tickets purchased include GST.  A 2% credit card processing fee will be charged in addition to the ticket value.

10. All ticket purchases are final and shall not be refunded or exchanged except as provided in the COVID-19 Policy at Point 24 below, the Live Performance Australia ticketing Code of Practice or as otherwise specified by OPERA UNDER THE STARS®. The 2% credit card processing fee charged for each booking is not refundable.

11. OPERA UNDER THE STARS® reserves the right to vary advertised programs, seating arrangements, and to add, withdraw or substitute artists at any time and without notice.

12. The right of admission is reserved. It is a condition of entry that a search of person or possession may be required at the time of entry to the venue. In the case of latecomers, they will be admitted at the discretion of Event Staff e.g. during a suitable applause break in the performance.

13. No person of 6 years of age and older will be admitted without valid proof of ticket purchase for admission.

14. Recording devices, video cameras and cameras may not be brought into the venue unless otherwise specified. A breach of this condition may lead to confiscation of equipment and removal of the ticket holder from the venue.

15. All pagers and mobile telephones must be turned off, including no vibrating sounds, before commencement of the performance.

16. By purchasing a ticket you agree to safeguard all physical proof of ticket purchase (including print at home confirmation emails) against loss or theft.

17. Ticket holders attending OPERA UNDER THE STARS® do so at their own risk and you are responsible for all personal items you bring with you to the event. In the case of children attendance is at the risk of their parent/s or legal guardian/s. To the maximum extent possible, OPERA UNDER THE STARS® is not responsible for any loss, damage, harm or injury arising from a ticket holder’s or person 5 years of age or younger attending free of charge, entry to the venue or attendance at the performance at the venue.

18. Children 5 years and younger may attend OPERA UNDER THE STARS® free of charge – by purchasing a ticket and agreeing to these Terms and Conditions including COVID-19 Policy you agree this event is not recommended or suitable for toddlers – on the condition they do not occupy a seat and they sit on the lap of a parent or legal guardian.

19. OPERA UNDER THE STARS® reserves the right to change any element of its sales structure, including but not limited to pricing, at any time and without notice.

20. OPERA UNDER THE STARS® reserves the right to film, video, record, photograph, broadcast or telecast the event.

21. OPERA UNDER THE STARS® collects your individual information via the #SoBroome website lest the need arises to contact you prior to the event e.g. in the case of event cancellation or change. If you fail to supply sufficient and appropriate contact information #SoBroome and/or OPERA UNDER THE STARS® will not be responsible for a failure to contact you. It is your responsibility to keep your contact details up to date.

22. We respect your privacy and are committed to protect the information you share with us and will not on sell, share or in any way provide your email address, or other personal information you may choose to provide, to any other entity or person without your express permission except if it is required by the government for COVID-19 contact tracing purposes (see Point 2 above).

23. OPERA UNDER THE STARS® reserves the right to change these Terms and Conditions including COVID-19 Policy at any time, effective immediately upon posting to and/or being displayed at the point of sale and/or at the event. The latest date of issue will be posted at the top of the Terms and Conditions including COVID-19 Policy.

24. COVID-19 Policy

Keeping OPERA UNDER THE STARS®, the Kimberley and WA COVID-Safe is the combined responsibility of everyone and OPERA UNDER THE STARS® has thorough protocols in place to achieve this. It is important that all patrons read and adhere to the following COVID-Safe event procedures.

Please STAY HOME if you feel unwell or have COVID-19 like symptoms.

Please do not attend OPERA UNDER THE STARS® if you…
i. Have tested positive for COVID-19; or
ii. Are waiting for a COVID-19 test result; or
iii. Have been in contact with a person suspected of having contracted COVID-19; or
iv. Have been directed to self-isolate or quarantine; or
v. Have COVID-19 like symptoms – for symptom information click here

If any of i, ii, iii, iv or v above apply to you it is your responsibility to contact #SoBroome as soon as possible by emailing info@sobroome.com.au to inform us of the above circumstances prior to the event.

If we receive your email or phone call at least 60 days before the event start time and date, a full refund will be issued. No refunds will be issued if you fail to inform us later than 60 days before the start time and date of the event.

If you contact us after 60 days before the event start time and date we will be unable to process a refund. This includes last minute government COVID-19 requirements including but is not limited to border and/or zone closures or changes to quarantine/isolation rules. However, if we have time, we will try our best to resell your ticket/s to an anonymous third party, if we are successful in reselling your ticket/s you will receive a full refund, if we are not successful in selling your ticket/s we will be unable to process a refund.

When applicable, refunds under this COVID-19 Policy will be processed by #SoBroome with monies received for ticket purchases refunded back to the credit card used to make the original ticket purchase. The 2% credit card processing fee charged for each booking is not refundable. 

You can choose to gift your tickets to someone else to attend if you are unable to attend OPERA UNDER THE STARS®. To do this you will need to email your ticket order confirmation email to info@sobroome.com.au advising us that you wish to gift your tickets and include the name, email address and contact number of the person you wish to gift the tickets to and include a ‘cc’ to the recipient of your gifted tickets in your email to info@sobroome.com.au

If you are unable to attend OPERA UNDER THE STARS® you can choose to donate the value of your ticket to support the event. To do this you will need to email your ticket order confirmation email to info@sobroome.com.au advising us that you wish to donate the cost of your ticket. 

25. Under these Terms and Conditions including COVID-19 Policy a refund will not be issued based on the following circumstances:

a. The ticket holder is well and does not wish to attend the event due to fears of exposure to COVID-19; or
b. The ticket holder is unwell and does not attend the event (other than due to COVID-19 illness or symptoms); or
c. The ticket holder is from a group at a higher risk of COVID-19; or
d. The ticket holder attends the event and subsequently leaves partway through due to feeling unwell; or
e. The ticket holder is travelling from another zone in Western Australia as advised by the Western Australian State Government, or from another State or Territory of Australia, or another country for which border/quarantine/isolation requirements have changed less than 60 days before the event start time and date.
f. The ticket holder decides not to attend the event related to the terms and conditions and/or situation of a third party associated with their travel.
